what is the difference between these two duplicate emails. Ive seen this a few times. one has a check box next to it and the other does not?

It looks like one is tied to an automation and one is not (hence the check mark box - one is able to be deleted and the other is not because it is being USED on something).

Jessica is exactly correct. If you click on the email template, you will see the automation it is tied to by clicking "automations" on the left side.
