All Activities
Assumption of Risks (General): The Activities involve inherent and significant risks that cannot be eliminated, even where JJE exercises reasonable care. These include falls, collisions, the normal movement and vibration of the equipment, unexpected mechanical shifts, automatic emergency stops, sudden stops or changes in speed or direction, human error, aggravation of pre-existing injuries or conditions, and minor, serious, or even catastrophic injury to persons or property damage. Catastrophic injuries can include permanent disabilities, head and spinal injuries, concussion, heart attack, stroke, and even death. I VOLUNTARILY ASSUME ALL INHERENT RISKS OF THE ACTIVITIES, KNOWN AND UNKNOWN, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, and I take full responsibility for any and all damages, liabilities, losses, or expenses that I may incur as a result of participating.
Alcohol, Drugs, and Fitness to Ride: I am not under the influence of alcohol or drugs, and I will not participate if I become so. I am physically able to participate. JJE may refuse, stop, or remove any rider it believes is impaired, unfit, or unsafe, without refund. If I participate while under the influence, I assume the added risk.
Rules, Instructions, and Operator Authority: I will follow all posted rules and operator instructions at all times. I have been given the chance to read the posted rules, watch the equipment being used, and ask the operator questions about it, and I am not relying on any oral statement about safety. JJE may stop any ride or remove any participant for unsafe conduct without refund. In this Agreement, "operator," "attendant," and "staff" include any employee, contractor, or volunteer, whether provided by JJE or by the event host, who sets up, operates, supervises, or assists with the Activities.
Synthetic Ice Rink
Acknowledgment of Ice Rink Risks: THE SYNTHETIC ICE RINK IS A HAZARDOUS SURFACE. Skating, gliding, and otherwise using the synthetic ice rink and related equipment involves inherent and significant risks, and falls are likely. The risks cannot be eliminated. Synthetic ice is a slick, low-friction surface capable of causing serious injury even where JJE exercises reasonable care. I understand the nature of this activity and the demands relative to my physical condition.
Potential Injuries: The risks of skating on the synthetic ice rink may cause minor, serious, or even catastrophic injury to persons or property damage, including falls, slips, and collisions with other participants, rink boards, or equipment; cuts and lacerations from skate blades or footwear, including fingers or hands cut by skate blades when someone falls; abrasions and friction burns from falling on the synthetic surface; sprains, strains, fractures, dislocations, and other musculoskeletal injuries; head, neck, and spinal injuries, including concussion; injuries from overcrowding, horseplay, or failure to follow rules or staff instructions; injuries from surface irregularities, moisture, debris, glide spray or lubricant, or weather conditions (outdoor installations); seams, edges, and minor shifting of rink surface panels that can exist even where the rink is properly installed, inspected, and maintained; and aggravation of pre-existing injuries or conditions. Catastrophic injuries can include permanent disabilities, spinal injuries, heart attack, stroke, and even death. I understand the types of injuries that might result from skating on the synthetic ice rink.
Medical Conditions: It is my responsibility to consult with my physician before participating in skating to ensure that my participation will not pose any unusual risks to my health or well-being. I do not have any conditions that skating on the synthetic ice rink would worsen, including pregnancy, a heart condition, a balance or mobility condition, or a recent or existing injury to my head, neck, back, or joints. I will tell JJE staff about any medical condition, mobility limitation, or pregnancy affecting safe participation.
Rules of Use: I agree to follow these rules:
- Follow all posted rink rules and staff instructions at all times
- Enter and exit the rink only when the attendant allows, and skate only in the direction the attendant directs, with all skaters moving the same way
- Wear appropriate, correctly sized skates as provided or approved by JJE, check that they fit properly before skating, and wear skates only on the rink
- Helmets are not provided by JJE; I may bring my own, and if I skate without one I do so at my own risk
- Do not bring hockey sticks, pucks, balls, or other equipment onto the rink
- Do not bring food, drink, or gum onto the rink
- If I fall, get up quickly or ask for help, and do not stop, sit, or lie down on the rink in the path of other skaters
- No jumping, spinning tricks, pushing, or skating in linked chains or trains, and no horseplay, racing, or any activity that endangers oneself or others
- Exit the rink immediately if instructed, or if experiencing dizziness, pain, or discomfort
- If the rink is at the posted maximum number of skaters, wait until the attendant lets me on
- Parents and guardians must supervise minors at all times; JJE does not provide childcare
JJE reserves the right to stop skating or remove any participant for unsafe conduct without refund.
Assumption of Risks: I assume all of the inherent risks of skating on the synthetic ice rink, including the low-friction nature of the synthetic surface, falls and collisions with other skaters, and surface conditions that exist even where the rink is properly installed, inspected, and maintained, and I take full responsibility for any and all damages, liabilities, losses, or expenses that I may incur as a result of participating. This assumption of risk includes the ordinary negligence of the Released Parties in the setup, inspection, maintenance, operation, instruction, supervision, and warnings relating to the synthetic ice rink, to the fullest extent permitted by law.
General Terms
Medical Treatment: I authorize JJE staff to arrange emergency first aid, transport, and treatment for the Rider if I cannot be immediately reached. Any medical treatment resulting from my participation shall be at my own expense or the expense of my personal insurer(s), and JJE is not responsible for medical costs.
Release of Liability, Including Ordinary Negligence: I VOLUNTARILY AND FOREVER WAIVE, RELEASE, COVENANT NOT TO SUE, AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, LIABILITY, AND CAUSES OF ACTION ARISING FROM ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, RESULTING IN WHOLE OR IN PART FROM THE INHERENT RISKS OF THE ACTIVITIES OR FROM THE ORDINARY NEGLIGENCE OF ANY OF THE RELEASED PARTIES during the event, including while on or near the premises where the Activities are provided, and including ordinary negligence in the setup, inspection, maintenance, operation, instruction, warning, or supervision of the Activities, to the fullest extent permitted by law.
Claims Not Released: NOTHING IN THIS AGREEMENT RELEASES OR EXCUSES ANY PARTY FROM LIABILITY FOR GROSS NEGLIGENCE, WILLFUL OR WANTON MISCONDUCT, OR INTENTIONAL TORTS, OR FROM ANY LIABILITY THAT CANNOT BE WAIVED UNDER MISSOURI LAW OR PUBLIC POLICY. This Agreement releases only claims based on ordinary negligence and the inherent risks of the Activities.
Indemnification Agreement: I AGREE TO HOLD HARMLESS, DEFEND AND INDEMNIFY THE RELEASED PARTIES from and against any and all claims made by (1) any Releasing Party that this Agreement releases, including my spouse, family members, heirs, and estate (but not a minor Rider's own personal injury claims, which are addressed under Minor Riders), or (2) co-participants, rescuers, and others, arising from injury or loss due to my participation in this event, including injury I cause to others, and from any loss, liability, damage, or expense, including reasonable attorneys' fees and costs, arising from my or the Rider's use of the Activities. If I or any Releasing Party brings a claim that this Agreement releases, I will pay the Released Parties' attorneys' fees and costs of defending it. This does not require indemnity for the Released Parties' gross negligence, willful or wanton misconduct, or intentional torts, and applies only to the extent permitted by law.
Minor Riders: If the Rider is under 18, the undersigned represents and warrants that they are the Rider's parent or legal guardian, have the legal authority to consent to the minor's participation, and do consent. The undersigned will supervise the minor and has confirmed that the minor meets each ride's height and weight limits. THE UNDERSIGNED, FOR THEMSELVES AND THEIR FAMILY, VOLUNTARILY ASSUMES THE KNOWN AND INHERENT RISKS OF THE MINOR'S PARTICIPATION, AND RELEASES THE RELEASED PARTIES FROM ALL CLAIMS THAT THE UNDERSIGNED PERSONALLY OWNS, INCLUDING DIRECT AND DERIVATIVE CLAIMS FOR MEDICAL EXPENSES, LOSS OF SERVICES, AND LOSS OF CONSORTIUM, ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. To the fullest extent permitted by Missouri law, the undersigned releases only claims that the undersigned personally owns or may lawfully release. Nothing in this Agreement is intended to release any claim that Missouri law does not permit a parent or guardian to release on behalf of a minor. The undersigned agrees to resolve the undersigned's own claims, and, where legally enforceable, claims relating to the minor's participation, under the Binding Arbitration clause, and, where legally enforceable, agrees to indemnify the Released Parties for any claim by a third party for injury or damage caused by the minor Rider.
Governing Law and Venue: This Agreement is governed by Missouri law. Except for disputes subject to the Binding Arbitration clause, venue for any court proceeding arising from this Agreement or the Activities lies exclusively in the courts located in Greene County, Missouri, and the parties consent to personal jurisdiction there. Those courts also have exclusive jurisdiction over any proceeding to compel arbitration, appoint an arbitrator, obtain emergency relief in aid of arbitration, or confirm, vacate, or enforce an arbitration award.
Binding Arbitration: ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATING TO THIS AGREEMENT, THE ACTIVITIES, OR THE RIDER'S PARTICIPATION, INCLUDING PERSONAL INJURY CLAIMS, WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION, NOT IN COURT, before a single neutral arbitrator under Missouri law and the Missouri Uniform Arbitration Act (and the Federal Arbitration Act where it applies). The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules in effect when the claim is filed. Those rules are available from the AAA on request or on its website at adr.org. If the AAA is unable or unwilling to administer the matter, the parties will agree on another neutral arbitration provider or arbitrator, failing which either party may ask the Circuit Court of Greene County to appoint a neutral arbitrator, and the arbitration will follow the AAA Consumer Arbitration Rules as closely as practicable. Hearings will be held in Greene County, Missouri, unless the parties or the arbitrator agree otherwise or the applicable rules permit a remote proceeding. JJE will pay all filing fees, administrative fees, and arbitrator compensation above the amount the claimant would pay to file a lawsuit in the Circuit Court of Greene County. Claims will be arbitrated individually and not as a class or representative action. Either party may seek emergency injunctive relief and may ask a court to compel arbitration or enter judgment on an award. This clause applies to the fullest extent permitted by law, including to Releasing Parties.
Jury Trial Waiver: TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING FROM OR RELATING TO THIS AGREEMENT, THE ACTIVITIES, OR THE RIDER'S PARTICIPATION THAT IS HEARD IN COURT INSTEAD OF IN ARBITRATION. I understand that I am giving up my right to have a jury decide any such claim.
Electronic Signatures and Records: I consent to sign this Agreement electronically. My electronic signature is legally binding and has the same force and effect as a handwritten signature. Electronic records of this Agreement satisfy any legal requirement that it be in writing, and copies are admissible in any proceeding to the same extent as the original, in each case to the fullest extent permitted by law.
Severability: If any provision or part of this document is found to be invalid or unenforceable, then that provision is severed from this Agreement, does not affect the validity of any remaining parts, and the remaining provisions stay in full force and effect. A court may modify any provision to the minimum extent necessary to make it enforceable, and any provision that can be enforced in part will be enforced to the maximum extent permitted by law.
Entire Agreement and Participant's Acknowledgement of Understanding: I SIGN FOR MYSELF AND, TO THE FULLEST EXTENT I HAVE LEGAL AUTHORITY TO DO SO, FOR THE OTHER RELEASING PARTIES, AND I AGREE THAT THIS AGREEMENT BINDS ME AND ANYONE WHO CLAIMS THROUGH ME. I HAVE READ THIS AGREEMENT, UNDERSTAND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, AND SIGN VOLUNTARILY. In order to be permitted to participate, I have read this form completely and carefully. I acknowledge that my participation is voluntary. This Agreement constitutes the entire agreement between the parties regarding its subject matter and supersedes all prior oral or written agreements on this topic.
By signing below, I acknowledge that I have read and understood this waiver and release of liability, and I voluntarily agree to its terms.
