COVID-19

The client, understand the updated COVID-19 regulations imposed by the government officials in Ontario stating the restrictions on social gatherings in Toronto, Peel Region, and Ottawa to 10 people indoors and 25 people outdoors effective as of Friday September 18, 2020 at 12:01am. The client, is fully responsible as the host for abiding by these regulations whilst renting equipment from FiestaRentals.

1.Warranties: There are no warranties of merchantability or fitness, either expressed or implied. There is no warranty that the equipment is suited for the client's intended use or that it is free from defects. Fiesta4kids does not guarantee units to be in spotless condition, units will have natural wear and tear, and units may have remnants of outdoor particles. Fiesta4kids Inc make no warranty of any kind on said equipment and the client agrees to notify Fiesta4kids immediately if any leased equipment has or develops an indication of deflect or improper working condition. The client agrees to use said equipment entirely at his/her own risk, to be liable for any damage to persons, it’s agents, servants, and employees from any and all liability resulting from the operation or use of the rented equipments.

2.Operation of equipment. The client agrees that all rented equipment shall be used and operated only by persons competent in its operation. The client further agrees to operate and maintain/service the equipment in accordance with instructions during the time it is in his/her possession, regardless of rental time stated on contract (s), and understands neglect to do so may result in an additional charge. The client acknowledges he/she understands proper use of equipment. The client further agrees not to operate the equipment in a careless or negligent manner.  If Client requires any tips or guidance, they should call Fiesta4kids Inc.

3.General terms and conditions: It is hereby agreed that the listed equipment is rented from Fiesta4kids Inc by the client for the client’s own use and the said equipment will not be loaned, sub-let, mortgaged or in any other manner disposed by the client. The client further agrees to be liable for any loss of said equipment by fire, theft or any other causes. Once the equipment has been accepted, either verbally or by signature, Fiesta4kids Inc would not be responsible for inclement weather and/or any other conditions which may cause the delay and/or cancellation of an event. Refunds, credits and/or rain checks will not be issued after an acceptance, either verbal, signed, or otherwise. Reservation deposits are non-refundable under any and all circumstances.

4.Damages: The client agrees to pay for loss or damaged equipments caused by negligence of the client, his/her employees or persons to whom the equipment is entrusted. The client further agrees to pay for loss or damage caused by the use of the equipment in violation of any terms of this agreement, and/or any accompanied agreement(s) and/or addendum's. If the client has insurance covering such loss or damage, the client agrees to exercise all rights available to him under said insurance, take all action necessary to process said claim, and assign said claim and any and all proceeds from said insurance to Fiesta4kids Inc, upon request of Fiesta4kids Inc, the client shall furnish the name of his insurance agent, insurance company and complete information concerning coverage carried.

5.Location: It is further agreed that the rented equipment shall be at the address specified by the client, which address appears on this rental agreement, the client grants Fiesta4kids Inc the right to enter said property. The clients agrees he/she has taken the responsibility to check the size of area, ceiling height (hanging light fixtures taken into consideration), and access to electrical outlets. Generators available for rent for an additional cost. The clients agrees he/she has given Fiesta4Kids all necessary information for delivery and set up- including parking space and distance to set up location, accessibility to party room via stairs or elevator, accessibility to party room through single or double doors, special instructions on the use of pegs or sandbag to secure units to the ground, and any other pertinent directions. No refunds will be awarded, if the structure does not fit in the location.

6.Supervision and care: The client agrees to supervise the operation, use and storage of the leased equipment from the time the equipment is put in the client’s possession and/or agreed premises until the time the leased equipment is recovered from the client’s possession and/or agreed premises. The client further agrees to surrender and return all the equipment leases at the specified herein in the same condition in which it was received, normal wear and tear excepted. If the client fails to return all the equipment in the before mentioned condition and/or agreed return time, the client agrees to pay Fiesta4kids the cost of the repair or replacement of any damaged or lost equipment and/or any late fees to be determined by Fiesta4kids Inc. The client hereby agrees to provide capable volunteers to supervise and man equipment unless agrees to pay for Fiesta4kids Inc Staff at an additional Cost. 

7.Hold harmless agreement: The client agrees to assume all risks and hold Fiesta4kids Inc harmless for any property damage caused by the leased equipment and/or arising out of possible Fiesta4kids Inc’s negligence. The client further agrees to hold Fiesta4kids Inc harmless from any claims made by any person, not a party to this lease which in any way may arise out of the operation, use, or storage of the leased equipment.  Client is responsible to supervise or appoint individuals who will supervise the users of the equipments at all times. User of equipment's do so at own risks.

8.Deposits and Payment: A 50% deposit is required in order to guarantee your reservation.Deposit to be used towards total value of rental. Deposits are NON-REFUNDABLE. Provided cancellation is made within the cancellation policy, Fiesta4kids Inc will allow you to reapply your original deposit in its entirety and reschedule your reservation within 12 months of your original event date (the event must be rescheduled within 12 months, it does not have to take place within the 12 months window). Fiesta4kids Inc makes no guarantees that your original equipment will be available for the day you intend to reschedule. If this occurs the client will need to choose an available date or chose another type of equipment. Should you fail to contact us or make arrangements to reschedule your event within 12 months, your deposit will be forfeited.

9.Payment: Full payment is due prior to event date. If paying by cheque, payment must be received 7 business days prior to event. If paying by credit card, balance to be charged on credit card 2 business days prior to event. Email money transfer is also available to epaymentfiesta@gmail.com.

10.Cancellations: Deposits are NON-REFUNDABLE. Customers canceling equipment orders upon delivery forfeit their deposit entirely due to contract labor expenses.Inclement weather cancellation must be made 24 hours before your event. Once the driver has left the warehouse deposits will not be applied to future events and are forfeited due to contract labor expenses. Outstanding payments are due in full one day before delivery. We will not discount or refund due to weather once delivery has been made. In the event of severe weather conditions (i.e rain, high winds etc), we reserve the right to cancel your reservations. If conditions are not too severe we will give you the option of keeping it or not. If you decide to keep the unit for the term of this agreement, there will be no refunds.
