Contract and Terms


Information & Terms: A refundable deposit of 30% and an authorized signature on your proposal will reserve your equipment and date. The balance is due 30 days prior to your event.  

Cancellation and Rain Policy: This contract, after signing, is a legal and binding contract. To cancel or reschedule, sufficient notice must be given - at least 30 days prior to start of your event. Cancellation of event with less than 30 days notice forfeits entire deposit. Cancellation after set-up has begun forfeits any refund. Postponement of event with at least 3-week notice may entitle you to use all or part of your deposit towards a timely rescheduled event at our discretion. Any rescheduled event is subject to availability of activities at the time of notification of postponement.

Decorations, Lighting and Tent alterations - any damage, stains, burns, remaining twist ties, holes, as a result of any alterations, lighting, securing, or decorations to this structure you will be charged for. A hole cut into a canopy can result in a whole new canopy needed to be purchased, not just patched.

Winds and safety - We reserve the right to change install times due to winds and temperatures. Side walls are not recommended in winds in excess of 30 kms. Winds in excess of 60 kms can jeopordize your guests and therefore we reserve the right to decide when and if tents should be erected. Only our crews can install or remove tent walls and windows. We reserve the right to refuse tent set up pending unsafe weather conditions such as excessive winds and weather events. We will not necessarily install tents in temperatures below 10 degrees Celsius - October - May months are very tricky months for tent installs - discuss with your sky high tent planner.  

WARNING: KEEP ALL FLAME AND HEAT SOURCES AWAY FROM TENT FABRIC

This tent is made of flame-resistant fabric. It is not fireproof. The fabric will burn if left in continuous contact with a flame source.

Weather: Client understands that tent are temporary structures designed to provide limited protection from weather conditions, primarily sun and rain; however there may be situations, particularly those involving strong winds and lightning, in which tents will not provide protection and may even be damaged or blown over. Evacuation of tents to avoid possibly injury is recommended when severe weather threatens the area where the tent is erected. People must leave the tents and not seek shelter in tents during such conditions. 

Site Preparation: Please be sure your site is ready (i.e. lawns mowed, vehicles out of the way etc.) before the crew arrives. For all tent rentals (not including canopies) client agrees to inform Sky High of the existence of any private underground utilities (i.e. phone or gas lines, septic system, pool pipes, irrigation lines, etc.), or conditions that may interfere with the ability to stake and/or anchor equipment. Client assumes all responsibility for all damage to underground equipment in absence of such notice.  Each tent install is different - depending surface and area. On average every 20 x 20 install can be 1.5 - 2 hrs in duration. Any alterations/changes to the surface indicated could result in refusal for set up - placing/building a floor on the surface prior to tent install without approval and coordination with office staff and prior to arrival of tent crews. 

On-Call Service: We provide 24-hour on call service to our clients. Additional charges may apply for this service if you first decided not to have walls and then want walls installed - resulting in a service visit or if you have altered the tent after set up and we are required to return, this too will result in a service charge at 75.00 per hour. 

Cleanup/Preparation For Pickup: All floral arrangements, trash, and decorations of any kind should be removed from tent before scheduled pickup time. Client assumes responsibility for all damages caused by decorations. Please be aware that some decorations can cause a permanent station on the tent, and other rental items. Please ask if you are unsure to avoid the cost of damages. Decorations must not affect the structural integrity of the tent. 

Additional charges may apply if:

  • The site is not ready or accessible when the crew arrives.
  • The tent and rented equipment is not ready for prearranged pickup.
  • Site requires custom tent installation (i.e. on asphalt, decks, immovable obstructions, etc).


Hold Harmless Provision: Lessee recognizes and understands that use of Lessor equipment may involve inherently dangerous activities. Consequently, lessee agrees to indemnify and hold lessor harmless from any and all claims, actions, suits, proceeding costs, expenses, damages and liabilities, including reasonable attorney's fees arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of said equipment including, but not limited to the delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless lessor from injuries or damages incurred as a result of the use of said equipment unless lessor is operating the equipment and is deemed by a court of law to be negligent in its actions. Lessor cannot under any circumstances be held liable for injuries as a result of acts of God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless lessor from any loss, damage, theft, or destruction of the equipment during the term of this contact and any extension thereof.
Merger Clause: This signed Agreement in conjunction with the signed Instruction Manual and Reservation Form contains the entire agreement between the Lessor and the Lessee. No amendment, whether from previous or subsequent negotiations between the Lessee and the Lessor, shall be valid or enforceable unless in writing and signed by all parties to this contract. The invalidity or unenforceability of any particular provision of this Agreement shall not affect the other provisions hereof.

Lessor will: 
1. Provide the necessary staff to facilitate your equipment set up
2. Deliver, set-up, and tear down and per times on contract
3. Carry a liability insurance policy covering our services & equipment.

Lessee  will: 
1. Provide clear vehicle and foot/trolley access and available contacts on site for set up instructions
2. Provide any required entrance and parking passes.
3. Remove everything from under the tent prior to scheduled take down time, otherwise a clean up fee of up to $50.00 will be imposed
