Contract and Terms

1. Item(s) listed in contract will be held for a maximum of 7 days from the original date of the contract; not including contracts printed less than 21 days prior to event date, which expire 24 hours from date stamp printed on contract.  If contract is not signed and returned to Hart Entertainment within the listed time frame, all equipment/services and pricing will be released and be subject to availability.

2.  A deposit payable to Hart Entertainment Inc., equal to FIFTY (50%) of the total fee,  non-refundable, shall accompany the return of this contract. The outstanding balance is due and payable to Hart Entertainment Inc. at least 48 hours prior to function date.  The total fee is payable if event is cancelled, for any reason including inclement weather, less than 45 days prior to the event date. 

3.  Hart Entertainment agrees to use its best efforts to provide equipment which is in good working order.  In the event that Hart Entertainment is unable to perform the services contracted due to any unforeseeable malfunction of its equipment, sickness or accident of the entertainers or staff, unavailability of replacement staff or if a performance is prevented, rendered impossible or unfeasible due to any cause beyond the control of Hart Entertainment, with the exception of inclement weather, or blowing wind (which makes the operation of inflatables unsafe) or other clause noted herein, it is understood and agreed that there shall be no claim for damages by the Client and Hart Entertainment’s obligation to perform such services shall be waived.  In the event one of the situations contemplated above occurs, all monies shall be returned in full.

4. The Client must ensure that the location at which Hart Entertainment is to provide the services agreed upon, has all necessary electrical outlets, electrical fixtures, electrical service capacity or related devices or capacities to allow Hart Entertainment’s equipment to be installed and function properly.  Client is responsible for all power needs and charges, unless otherwise noted in contract.

Client must provide break area and validated parking for all Hart Entertainment staff and entertainers.  Please call us for dimensions.

5. Client is responsible for providing adequate space to set-up rental items.

If item(s) are unable to be set-up for any reason out of Hart Entertainment control (i.e. inadequate space, lack of power, or location restrictions, etc.) Client will still be responsible for payment in full for rental item(s).

Hart Entertainment must have access to event site at stated Set-up/Strike time on contract.

Delivery fee may increase if Client requests item(s) to be delivered earlier than stated time.

In the event Hart Entertainment is unable to strike/pick-up/tear down equipment / item(s) at contracted time an additional fee may be billed to Client.

Hart Entertainment will need truck access to the location for set up and strike of rental items. If not setting up on ground level of a building, Hart Entertainment must have oversize elevator access and double door entryways. Any stairs entering or within building may hamper our ability to set up.

6.  Hart Entertainment reserves the right to substitute entertainers, equipment or prize merchandise of the same caliber where necessary, and at its sole discretion.

7.  If for any reason, Hart Entertainment is unable to perform the services contracted above due to any oversight or any negligence on the part of the Client, or due to the breach of any term or covenant of this agreement, by the Client, all deposit monies are forfeit and any balance that would have been due upon full performance of the services contracted, shall immediately become due and payable.

8.  Hart Entertainment will not be liable in any way for personal injuries or damage to the property of the Client, the Client's guests, invitees, agents, employees, contractors or any other person.  It is expressly agreed that Hart Entertainment shall in no event be liable for special, indirect or consequential damages.

9.  The Client agrees to indemnify and save harmless Hart Entertainment, it's associates &/or agents for any and all liability with respect to the injuries and damages referred to in the preceding paragraph.

10.  Overtime charges are pro-rated per 1/2 hour.  Client agrees to pay all costs of collecting past due amounts including, but not limited to, actual attorney fees, collection fees and court costs.  A service charge of 2% per month will be charged on past due accounts.

11. Clients are responsible for all loss and damage to equipment while in their possession & until Hart Entertainment removes equipment.  Protect equipment from water & other liquids or hazards.

12.  A signed contract guarantees that Hart Entertainment will receive a 50% deposit within two weeks of receiving the signed contract from Client.

All payments will be made to: Hart Entertainment Inc.

Payments can be made via check, Visa, American Express or Master Card.

13.  The Client acknowledges that Hart Entertainment will begin preparing for, and incurring costs in connection with the event/program soon after this contract is signed. Client understands that if Client decides to terminate/ alter/ make any changes to this contract prior to the event / program, for any reason whatsoever financial penalties may apply.

14.  Client understands by decreasing the contracted and or decreasing the package total price there may be changes, decreases or cancellations of any discounts given on contract.

15.  When and if a Client chooses to provide their own staff to operate and / or oversee the use of any rental or contracted item(s) the Client releases Hart Entertainment from all liability and Client willfully accepts responsibility for safety and liability for all guests and attendants at contracted event.
